The ACNC has published an updated Commissioner’s Interpretation Statement (CIS) on Health Promotion Charities following consultation with the sector.

The CIS explains the ACNC’s view of how Health Promotion Charity is defined.

The ACNC undertook public consultation which included releasing an exposure draft and taking submissions to canvas proposed amendments.

To be entitled to registration as a Health Promotion Charity, an organisation must demonstrate that it is ‘an institution whose principal activity is to promote the prevention or the control of diseases in human beings’. This description is a composite, and an organisation must demonstrate that it meets all the elements of the description.

The updated CIS contains a section explaining that the ACNC will group similar activities together for the purposes of determining principal activity. It also contains a section explaining how the ACNC will treat an organisation’s administrative functions when determining the organisation’s principal activity.

A description of the issues raised in stakeholder submissions and the ACNC’s response to them has also been published in a compendium on the ACNC website.

The updated Commissioner’s Interpretation Statement on Health Promotion Charities does not narrow our interpretation of Health Promotion Charity. Charities that are currently registered under this subtype will continue to meet the description under the updated statement.
